Buying property in Marrakech and Morocco

What our advisors explain to every buyer before the first viewing. These are general points: the notaire always confirms the rules and figures for each house.

Can a foreigner buy property in Morocco?
Yes. Foreign buyers can own titled residential property in Morocco outright, on the same terms as Moroccan citizens. Agricultural land is the exception: it cannot be bought by foreigners without a specific procedure, so a farm or a plot outside the urban perimeter needs checking before any offer.
What is a titre foncier, and what is melkia?
A titre foncier is a title registered with the Land Registry (Conservation Foncière); it is the safest form of ownership and the one to look for. Melkia is a traditional deed, common in the medinas. It can be converted into a titre foncier, but the process takes months and should be reflected in the price.
What are the buying costs in Morocco?
For a titled property, expect roughly 6 to 7% of the price on top: about 4% registration duty, 1.5% Land Registry fee, and the notaire's fees (around 1% plus VAT). Your notaire gives the exact figure for each house before you sign.
How does a purchase work?
Once a price is agreed, a notaire draws up a preliminary agreement (compromis de vente), usually with a deposit of about 10%. The notaire checks the title, debts and permits, then the final deed is signed and registered. Allow one to three months for a titled property.
Can I take my money out again when I sell?
Yes, provided the purchase was funded with foreign currency brought into Morocco through a bank and documented. Keep the bank's exchange certificates: they are what allows the sale proceeds to be transferred back abroad.
Why do you ask for budget and timing before a viewing?
Out of respect for the owners, many of whom live in their houses, and for your time. With your budget, timing and means of purchase, your advisor shows only the houses that fit, and can open the private folio of houses that are never published.
